Why do you need a Will?
A Will is a document which sets out how you would like your assets to be distributed when you die and who you would like to be responsible for carrying out your wishes. An up-to-date Will will ensure the right people are provided for when you die. The person or persons responsible for managing your estate will better understand how you would like your affairs managed. Your assets will be distributed according to your wishes, preventing unnecessary stress for your family and enabling your estate to be settled quickly and efficiently.
If you die without a Will, your estate will be distributed according to state legislation. The court will have the right to determine who will manage your estate, and the net value of your estate will be shared between your living relatives according to Western Australian law. If you don’t have a Will, you will have no say as to who will benefit from your estate once you die. Your estate may take a long time to settle and cost significantly more than if you have a Will.
If you already have a Will, you should consider making a new Will if you buy or dispose of a significant asset such as a home or business, if you adopt or give birth to a child, or if you want to change the executor or beneficiaries named in your Will. A Will is usually revoked upon marriage or divorce – so if you get married or divorced you should always make a new Will.
